Mediation is an alternative resolution mechanism to the traditional court proceedings. It is a form of Alternative Dispute Resolution (ADR) and is often referred to as “facilitation”. Mediation is either commenced voluntarily, with or without a pending case, or court ordered in a pending case. Unlike arbitration (another form of ADR), mediation is non-binding and is dependent upon the willingness and ability of the parties and the mediator for a successful resolution. Mediation has become more popular as a way of resolving disputes especially considering the uncertainty and cost of litigation.
For many people mediation provides a preferable alternative to a litigation solution. These matters are handled on an hourly basis. Our office offers probate mediation services and is currently accepting referrals.
